Hi,

I just want to say, WOW, I really love the look of you footage, I think it looks really great and I think I could really find uses for it when I get round to filming my movie(once I got my new cam).

I just wanted to ask, it may just be me being stupid but what are the restrictions on using your footage? Can we use it for broadcast, TV, etc...?

Also, how do FXhome users go about getting 20% off?

I mean it not like it would effect me because if I by some sof your footage, I would probably buy one of the bundles just to get most of the the stock, I mean nothing against your photos/textures, I would probably on use the stock footage, is there any plans on creating a bundle with just the stock footage? I mean If I was to buy a bundle would it be possible to subsitue/change volume for another volume that isn't in the bundle?

I completley understand if this isn't possible, and I am in no way trying to mess/cause trouble with the way you work, I just wanted to ask a few questions smile

I hope you don't feel offended by my questions smile

You can use our footage for any media such as TV commercials, movies, home use etc. You cannot use it as part of any selling product, such as screen-savers, stock footage, VJs loops, etc.

REAL LIFE STOCK FOOTAGE

We are in the process of creating different "Real Life" footage and should be ready soon. As of now, we have SCENIC CLOUDS, FIREBAST, WATERWORKS and SMOKE & FOG, the rest are FX such as LIQUID FLOW, SYNTHETIC TEXTURES, etc.

VOLUME SUBSTITUTION WHEN BUYING A BUNDLE

You can choose any volume from our library. If you see a bundle but it does not have a volume you want it, is because we have not update the listing, but the fact is that you can select whatever you want.

FUTURE VOLUMES

Our current list of "thing to do" do not includes real explosions, but definitely some CG. Soon we will be releasing a couple of new volumes, so visit us each week.

Thanks for the reply, I just want to clarify that if there was a bundle say the $99.99 dundle, can I subsitute the 'Textures' for 'WaterWorks'?

I am really looking forward to the future volumes, I am abit upset about real explosions, lol JK, just that I am one more for real if it is possible smile

Just one thing you said we can you it is if it is not used as a selling product, does this mean that we can not sell our movies on DVD, I know you say only as long as it doesn't take up 25% of the length of the final product, but how do you/we know if it is taking up 25%? Also what if we were doing a project that depended on a high level of effects like these, where would we stand?

Sorry for all the questions, it is just that I want to make sure I know everything before I buy smile

Hello again:

Hope all is good. Yes, you can change or substitute any volume in any bundle. For example, you are interested in the 2 PACK which is $99.95, you just need to let me know which of the volumes you want.

The bundles where created to make the shopping experience a lot easier and save more money at the same time, rather than buying the individual volumes.

The fact that real explosions are not on our current "to do list" does not mean we will not do it, it means we need to finish those on the list before making another one and there is not a timeframe.

Selling product means you cannot take our footage and sell them or mix it up with something else and sell them. For example, lets say you want to create a DVD screensaver for plasma TV and sell them, you cannot do that.

In your particular case, you can sell your movie, it was created and done by you, however, our footage cannot exceed 25% of the lenght of your movie.

For example, let say your movie is a 10 minutes short film, 25% of 10 minutes of video is equal to 2 minutes and 30 seconds. This means, that you can use the footage up to 2 minutes, 30 seconds, anything above that will be exceeding 25%.

That is completely undersatandable and fair, I was just wondering if someone was to exceed more than 25% what would happen, would there be a charge? I mean I am looking at buying your footage and in the planning stages of a project and doing some test runs of certain bits, and I am not sure how much of the project it will take up, I mean I really like the look of your footage and I really am interested in buying it but the thing is that I am scared of exceeding 25%, and I don't want to cause any trouble at all.

This is an standard regulation for the stock footage industry. 25% is a lot when it comes to a movie, specially if later on you plan to sell your movie.

We, as well as many other companies can allow you to exceed that amount, but there are fees and has to be done under a writing contract and signed by both parties.

When someone exceed that amount without authorization, is taking a risk of a legal suit. Chances are that if you do a home movie, no one may ever find out, however, if you sell them you are exposing it to the public, and when you do that, thousands of people will be in touch with you material.

Even if 20 years pass by and your material is found, there might be a chance to file a suit. Also keep in mind that anything is a business to anyone.

RELAX

I'm just explaining you how the industry works! If you think you may exceed let me know, I can arrange something for you and have it in writing. This is very important because we are small today, but we may grow, and if we grow there will be many legal issues to take into account. Also if the company get sold, you are covered under a contract.

It make sense to ask questions, it show that you make decisions based on facts, not guessing around, so don't worry about your questions, I'm here to help.
