My effects are masking on their own whats wrong?

I need them to be on top of my footage...

From your description all I can gather is that you need to upload your video onto the timeline before adding the effect. Make sure your video is on the bottom in the track listing, below all of your objects.

Either that or you doing something funky with masks.

I would watch this tutorial on the timeline which will help you layer your effects and video sources better:
